Who keeps the Firmenbuch — and who issues the apostille.

The Firmenbuch is kept electronically by the Firmenbuchgericht, a division of the Landesgericht — in Vienna the Handelsgericht Wien — under the Firmenbuchgesetz (FBG) in conjunction with the Unternehmensgesetzbuch (UGB); anyone can inspect it via the Firmenbuch database of the Austrian judiciary. Every legal entity — whether an e.U., OG, KG, GmbH or AG — is listed under a single Firmenbuchnummer (FN); unlike some neighbouring registers, the Austrian Firmenbuch has no separate partnership or capital-company sections. There is a current extract and a historical (chronological) extract.

Because the extract comes from a court, a certified Firmenbuchauszug originates from the Landesgericht or a notary. If it needs an apostille for use outside the EU, that is issued in Austria by the president of the Landesgericht — not by the translation provider. FÜD does not issue apostilles; we name the competent authority and then translate the apostille together with the extract.
